Lockdown: Are the Family Law Courts in Brisbane keeping up with COVID crisis?
The Family Law Courts are busy places at the best of times, with often long delays until cases get to trial, and a decision is published. The COVID lockdowns certainly have not made that any easier or quicker. The Courts are also having to manage the impact of a merger. From the 1 st of September 2021 the Family Court and the Federal Circuit Court, who both currently hear cases under the Family Law Act, will merge.
In response to these challenges, the Family Law Courts Brisbane have introduced a number of measures to try and assist the situation, and these include:
- Except for trials, most Court appearances are being conducted either by telephone or video conference link.
- Court documents such as Applications and Affidavits are permitted to be signed electronically on your behalf by your solicitor.
- The Court has introduced a special COVID list so that if you have an urgent situation that arises directly or indirectly as a result of the COVID pandemic it is possible to request an urgent listing of your application.
- The Court has conducted a call over of many of the family law applications currently in the system, with a view to encouraging as many cases as possible to try and resolve the dispute by mediation.
- There have been changes to the arrangements within the Court building to limit the number of people in the building, and everyone who does attend has to check in with the COVID app.
