Are you aware of your rights to contest any decision made by the Department of Communities (Child Safety) in relation to your child or children?
The Department of Communities has the authority to intervene to provide support and child safety assistance for a young person and their family to meet their protection and care needs.
If the Court believes that a child or young person is in need of protection and a parent is not able and willing to protect them then the Department may apply to the Children’s Court for a court assessment order or a child protection order.
We have the expertise and legal knowledge to
- Negotiate with the Department on your behalf to ensure full child safety
- Represent you on any temporary assessment applications by the Department
- On the mention or hearing of any application made to the Court
It is important in these circumstances to know your rights as a parent. We at Family Law have the knowledge and expertise to assist you in your dealings with the Department and to represent you on any Court hearing should an application be made by the Department to the Court in regard to your child. A Court will not necessarily grant an application for a child to be removed from a person’s care.
