The Court Process
Often when two people separate, one of them will come to see us and seek legal advice and maybe looking to make an application to the court. Having an understanding of the court process will assist you to prepare for your involvement in that process. If things aren’t good in the relationship and when a party is looking to take some action to protect their interests and get what they think is fair. (Court Process)
After the separation, our job as solicitors is to provide advice, that is consistent with the law and to ensure that a party is not looking for things that are unreasonable; whilst ensuring that, they can still get what they want, but it is consistent with their legal position.
It’s really important, to seek legal advice to figure out; what the best steps to take care of you and even consider steps that don’t involve court at all.
Sometimes, it can involve just negotiating between the two of you to try and reach a property settlement or to come up with some parenting arrangements; that is suitable given all the circumstances – but sometimes court does become necessary and we can take that step for you if you fail to reach the agreement with your partner. Sometimes, you just need to move on with your life and that is the best mechanism.
