Instead, they act as an objective, independent advocate who gathers evidence and makes recommendations to the Court based solely on what will provide the best long-term outcome for the child.
As Ian Field describes it, the mission is clear: “I represent the best interests of children who are the subject of proceedings in the family court. I try to assist the Court and the parents… to make the best possible decisions for the children, and try to ensure that the best interests of the children remain at the forefront of everyone’s mind.”
Why the Role is Fundamental to the Community
The work of an ICL is a cornerstone of a healthy community. When family units break down, the emotional and psychological ripples can last a lifetime. If the decisions made during a court case are incorrect or fail to address the safety of the child, the results can be devastating.
Ian emphasises the weight of this responsibility: “I think this role is fundamentally important because if the decisions that get made about children are not the right decisions, that can have catastrophic consequences for the children. If we get the decisions right, we can make a real difference to those children, and give them the best possible chance of enjoying their childhood.”
By providing a specialised focus on the child, ICLs help break the cycle of conflict. They ensure that children are not just “objects” of a legal dispute, but the central priority of the legal system.

One of the most significant, yet often unseen, aspects of an ICL’s work is their ability to facilitate settlement. While many imagine family law is all about dramatic trials, much of the most important work happens in the hallway of the court or in a boardroom during a mediation.

Because they are independent and do not represent either parent, they can offer an objective perspective that parents are more likely to trust. Ian notes that many of his cases settle because of this intervention: “I have had a lot of trials that we have managed to settle by consent, and I have had a significant part in persuading parents to reach a compromise. When that happens the chances of the agreement being an enduring one… is much higher.”
When parents reach a compromise, it doesn’t just end the legal fees; it sets the stage for a more constructive co-parenting relationship. This is perhaps the greatest gift an ICL can give a community: a path forward where parents can focus on their children rather than their grievances.
Giving a Voice to the Quietest Participants
While an ICL focuses on the child’s best interests (which may differ from what a child wants), they play a vital role in ensuring children are heard. For older children, the ICL ensures that their views are placed before the Court. This gives the child a sense of agency and ensures the Judge has a full picture of the child’s lived experience.
In more serious matters, the ICL is the frontline protector. In cases involving allegations of risk, domestic violence, or substance misuse, the ICL is responsible for ensuring the Court has all the necessary evidence to keep children safe. Ian recalls that the cases that stand out most in his career are those where he played a part in removing children from care arrangements where they were at risk. These “life-saving” interventions are a testament to why the ICL role is often described as the most important job in the courtroom, second only to the Judge.

Being an ICL is not an easy career choice. It involves dealing with families in crisis, facing evidence of trauma, and navigating the increasing complexity of mental health issues and domestic violence. When asked why he chose to become an ICL, Ian’s answer was simple: “The children didn’t ask for their parents to separate, and they deserve a system that puts their interests first.”
